Noise Nuisances Curfew For Persons Under Eighteen Years Of Age
(A) Definitions: As applicable to the curfew for persons under eighteen years of age within any of the unincorporated areas of the township, the following definitions shall apply:
1)"Minor" means any person under eighteen years of age;
2)"Parent" means the natural or adoptive parent of a minor;
3)"Guardian" means any person other that a parent who has legal guardianship of a minor;
4)"Custodian" means any person eighteen years of age or older who is in-loco-parent is to a minor.
5)"Public Place" means any alley, street, road, highway, or right of way, including sidewalks, parks, playgrounds, grounds, place, building or lands open to the public; any privately or publicly-owned place of amusement, entertainment, or public accommodation, to include any parking lot and other common areas or public areas adjacent thereto; and any vacant lot or land, or, any private property without the consent of the owner of said private property.
(B) The curfew for minors and persons under eighteen years of age:
1)No minor shall loiter, idle, wander, stroll, play, be within or upon any vehicle or be at , in or upon any public place within the unincorporated areas of Perry Township, Stark County, Ohio, between the hours of 12:00 p.m. (midnight) and 6:00 a.m., Sunday night through Thursday night.
2)No minor shall loiter, idle, wander, stroll, play, be within or upon any vehicle or be at , in or upon any public place within the unincorporated areas of Perry Township, Stark County, Ohio, between the hours of 12:30 a.m. and 6:00 a.m. Friday night through Saturday night.
(C) Provided that the provisions of this Resolution shall not apply to the following:
1)To a minor accompanied by a parent, guardian, custodian having legal or actual custody or control of such minor;
2)To a minor who is on an emergency errand or specific business or activity directed, permitted or instructed by his parent, guardian, or custodian having the legal or actual care and custody of said minor;
3)To a minor who's presence is connected with or required by some legitimate employment, trade, profession, or occupation;
4)To a minor attending or returning within one hour after the conclusion thereof, from any scheduled activity by any school board of education or from any other special functions scheduled by any other church, school, civic or charitable organization.
BE IT FURTHER RESOLVED by the Board of Trustees for Perry Township, Stark county, Ohio, that the Perry Township Police Department, the Stark County Sheriff's Department, the Ohio State Highway Patrol, or any other duly authorized police or law enforcement agency are authorized to enforce this Resolution and, pursuant to Ohio Revised Code Section 505.89 (B), any person under eighteen years of age who violates this curfew shall be charged as being an unruly child and taken before the Juvenile Court as provided in Chapter 2151 of the Ohio Revised Code. Perry Township Parks On September 15, 1998 the Board of Trustees amended the park rules so that the parks would be closed from sunset to sunrise, from Labor Day to Memorial Day. |
