Perry Township Board of Zoning Appeals

Be it remembered, that upon the hearing of the above-entitled matters, held at the Perry Township Administration Office, Massillon, Ohio, before the Perry Township Board of Zoning Appeals, and commencing on Monday, the 5th day of December 2011, at 7:30pm, at which time the following proceedings were had.

Mr. Stergios:  The meeting will come to order.  This meeting will be tape recorded.  Proceedings of the Perry Township Zoning Board of Appeals are rather informal.  All those wishing to testify on any matter, either for or against, must take and oath.  Please raise your right hand.  (Thereupon, all potential witnesses were sworn).  Appeals from decisions of this Board are to the Stark County Court of Common Pleas pursuant to the Ohio Revised Code. 

 

Case 19-11A- Thomas A. Marino- 143-149 Eden Ave. NW, Massillon, Ohio 44646, Parcel #43-13182

Thomas A. Marino- 2945 12th St. NW, Massillon, Ohio 44646 has made an application for a variance to construct a 36’x36’x16’ detached garage at the above stated address.  The proposed garage is one thousand two hundred and ninety-six (1,296) sq. ft.  When combined with existing accessory structure on this property, the proposed garage exceeds the maximum square footage allowed for this size lot by one thousand twenty-nine (1,029) square feet in an R-3 Single Family, Duplex & Four Family Residential District. [Section 602.4- Perry Township Zoning Resolution]

 

Tom Marino- 2945 12th St. NW, Massillon, Ohio 44646.  Mr. Marino stated that the variance requested is for an accessory building to store equipment for lawn maintenance and snow removal.  The proposed building would be located behind a four plex used as a rental property.  Currently the equipment is being stored outside and along the road.  This is an eye sore and is a danger.  Also, inclement weather conditions cause wear and tear on the equipment.  Mr. Marino stated that they understand the importance of living in a clean neighborhood.  The proposed building will be aesthetically pleasing.  The proposed garage is one thousand two hundred and ninety-six (1,296) square feet, 36’x36’x16’.  This building will help a growing Perry Township business.

 

For: 

 

Mike Marchewka- Mr. Marchewka stated that he is for the garage.  Mr. Marchewka is hoping the new construction will bring up the property values as well as keep kids from causing property damage in the area.

 

Against: 

 

Dave Corbett- 209 Eden Ave. NW.  Mr. Corbett stated that he is upset that the Marino’s tore down his hedges that he put in for privacy reasons.  Mr. Corbett stated that he is opposed to the proposed construction for that reason.

 

Motion:

Mr. Holland made a motion to deny the variance requested in case 19-11A; Seconded by Mr. Wilhelm.

 

Mr. Holland is concerned about the percentage over the maximum square footage allowed.  Mr. Holland does not want to set a precedent in the area.  Mr. Wilhelm inquired if this is the smallest building they could construct.  Mr. Marino stated that it is the smallest size building for what they are trying to store.  Mr. Stergios inquired where the access would be to this garage.  Mr. Marino stated that there is a drive on the south side that will be extended back to where the proposed garage would be.

Case 20-11A- Terry Roan- 516 Orrville St. NW, Massillon, Ohio 44647,

Parcel # 47-00195

Terry Roan- 516 Orrville St. NW, Massillon, Ohio 44647 has made an application for a variance to construct a 32’x32.5’x12’ detached garage addition at the above stated address.  The proposed garage addition is one thousand forty (1,040) sq. ft.  When combined with existing accessory structures (attached and/ or detached) on this property, the proposed garage exceeds the maximum square footage allowed for this size lot by five hundred twenty six (526) square feet in an R-3 Single Family, Duplex & Four Family Residential District. [Section 602.4- Perry Township Zoning Resolution]

 

Mr. Roan- 516 Orrville St. NW.  Mr. Roan stated that he is requesting a variance to build a 32’x32.5’x12’ garage addition.  Mr. Ed Rohr (contractor) explained the design of the proposed structure.  The proposed structure will exceed the maximum square footage allowed by five hundred and twenty-six (526) square feet.

 

For:  None.

 

Against:  None.

 

Motion:

Mr. Wilhelm made a motion that the variance in case number 20-11A be approved; Seconded by Mr. O’Brien.

 

Mr. Holland inquired if the current shed would be removed from the property once the garage is built.  Mr. Roan stated that was correct.

 

ROLL CALL:  Mr. Holland, yes.  Mr. O’Brien, yes. Mr. Wilhelm, yes.  Mr. Stergios, abstain.

Case 21-11A- Gary Grover- 4933- 14th St. SW, Canton, Ohio 44710,

Parcel #43- 01476

Gary Grover- 4933- 14th St. SW, Canton, Ohio 44710 has made an application for a variance to construct a 14’x14’x12’ attached addition at the above stated address.  The proposed addition will be five (5) feet from side property line where ten (10) feet is required in an R-2 Single and Two-Family Residential District [Section 602.4- Perry Township Zoning Resolution]

 

Mr. Grover was unable to attend the meeting.

 

Mr. Holland made a motion to proceed; Seconded by Mr. O’Brien.

 

ROLL CALL:  Mr. O’Brien, yes.  Mr. Holland, yes.  Mr. Wilhelm, no.  Mr. Stergios, abstained.

 

Mr. Grover is requesting to construct a 14’x14’x`2’ attached addition at 4933 14th St. SW.  The proposed construction will be five (5) feet from the property line where ten (10) feet is required.

 

For:  None.

 

Against:  None.

 

Motion:

Mr. Holland made a motion that the Board approve the variance in case number 21-11A; Seconded by Mr. O’Brien.

 

ROLL CALL:  Mr. O’Brien, yes.  Mr. Holland, yes.  Mr. Wilhelm, no.  Mr. Stergios, abstained.

 

APPROVED.

 

Approval of Minutes:

 

Mr. Stergios made a motion to approve the minutes of the November meeting; Seconded by Mr. Wilhelm.

 

ROLL CALL:  Mr. Holland, yes.  Mr. Shefelton, yes. Mr. Wilhelm, yes.  Mr. Stergios, abstained.

 

Reinstatement Recommendation:

 

Mr. Stergios made a motion that the Board of Zoning Appeals request that Mr. Wilhelm be reinstated to a new term; Seconded by Mr. Holland.
