Regular Meetings 

 The Perry Township Board of Trustees meets in Regular Meeting format on the first and third Tuesday of every month at 7:00 PM.   

The meetings are held at the Township Hall located at

3111 Hilton Street NW

in Massillon. Regular Meetings include reports by Department Heads, the Law Director, and the Township Administrator.  The public is welcome to offer comments during the Public Speaks portion of the agenda on township related matters.

Call to Order/ Pledge of Allegiance:

Additions/Deletions to Agenda:

 

Trustee Haines stated that there is one addition to the agenda under the Road Department; to consider the resignation of casual employee, Clifford Lackey.

 

Trustee Chessler made a motion to add this item to the agenda; Seconded by Trustee Laubacher.

Public Hearings/Invited Guests:

 

Street Lighting Hearing for 12th Street and Sippo Streets SW

 

Trustee Haines stated that in reference to the Street Lighting Hearing for 12th Street and Sippo Streets SW, the Petitioner is Mr. Tim Laps.  There are 3 street lights and 11 parcels at $10.00 per light.  Breakdown cost:  $16.36 per 6 months per petitioner, or $32.72 per year.  The district is 5158 12th Street SW, Canton, OH  44710.

 

 The petition was circulated on July 30, 2013 and was verified that the signatures were greater than 50% of the front feet of the lots and lands abutting on the streets and public ways in the district.  The legal description of the post district is attached to the petition.  On October 10, 2013, the petition was filed with the Fiscal Officer.  On November 12, 2013, the Fiscal Officer notified the Trustees of the date of hearing.  On November 15, 2013, the Fiscal Officer delivered a copy of notice to every landowner at least fifteen (15) days before the hearing.  On November 18, 2013, the Fiscal Officer published the notice in the newspaper one time at least two weeks before the hearing.  That brings us to tonight, December 3, 2013, the Fiscal Officer’s set date of the hearing.  There is proof of publication by the Fiscal Officer before the date of the hearing.  Notice to all Trustees that they are aware of this address and location of the street lighting district has been confirmed. 

 

Trustee Haines stated that he sees no residents present at the meeting to speak for or against this petition and makes a motion that the Board of Trustees approve the lighting district for 12th Street and Sippo Streets SW, Canton, OH 44710 for 3 street lights and 11 parcels at $10.00 per light for a yearly fee to each parcel owner of $32.72; Seconded by Trustee Chessler.

Communications: 

 

Letter to Board of Trustees from June Lamielle

 

Trustee Haines stated that the Board received a letter from L.A. Floom on behalf of Mrs. June Lamielle who resides at 3551 Mollane St. NW regarding a vacant lot next door to her with a tree that hangs over her property.  Trustee Haines stated that Zoning Inspector Weckbacher has taken photographs of this tree and indicated that Law Director Hall has also seen the tree as well.  Mr. Hall gave a brief explanation regarding the status of the property.  Mr. Hall stated that the property where the tree is located remains in the name of the deceased homeowner and stated that he does not see that the Board would have any jurisdiction over this private property enabling any action to be taken.   Law Director Hall stated that if the Board would so direct, he would contact Mrs. Lamielle and her neighbor to discuss the circumstances and what options might be available to them in this matter.  It was agreed that Mr. Hall would contact the parties involved.

Trustee Haines made a motion to approve bills in the amount of $198,253.66 for the week ending November 26, 2013 and approval of bills and payroll in the amount of $308,507.92 for the week ending December 3, 2013 for a combined total of $506,761.58; Seconded by Trustee Laubacher.

Fiscal Officer: 

 

Trustee Haines made a motion to accept the minutes of the November 19, 2013 Regular Meeting; Seconded by Trustee Chessler.

 

Consider Amended Certificate Increase for Receipt and Appropriations for Accounts – 02~Motor Vehicles $16,536.92 and 03~Gas Tax $9,822.11

 

Fiscal Office Schlegel stated that he would like to request the Board to make a motion to increase the receipt and appropriations for Accounts 02~motor vehicle fund in the amount of $16,536.92 and our 03~gas tax fund in the amount of $9,822.11.  This increase request is due to the Township receiving more gas and motor vehicle taxes than expected as well as the colder weather conditions.

 

Trustee Chessler made a motion that the Board of Trustees approve an amended certificate increase for receipts and appropriations for the Accounts 02 and 03 as outlined by the Fiscal Officer in the amount stated; Seconded by Trustee Haines.

 

Trustee Laubacher verified of Fiscal Officer Schlegel that these monies would be under the Road Funds .  Mr. Schlegel stated that was correct.  Mr. Schlegel also indicated that due to the overtime that has already taken place because of weather conditions, this increase would be secured for overtime salary purposes.

Administration:

 

Consider Ohio EPA Annual Discharge MS4 Permit Fee ~ $1,500

 

Administrator Fetzer stated that she is requesting the Board to consider making a motion for payment of the annual discharge invoice fee from the Ohio EPA that applies to all MS4 Operators pursuant to ORC 3745.11 (L)(6) in the amount of $1,500.00 –  Permit #: 3GQ00053 BG.

 

Administrator Fetzer stated that over 500 entities in Ohio including townships, villages and cities are required to obtain an annual discharge permit.  Storm water discharge has been proven to cause multiple problems for our rivers, lakes and streams.  In an effort to keep pollutants under control, the Ohio EPA has enforced this annual permit.

 

Trustee Haines made a motion that the Board authorize the payment of the annual MS4 permit fee in the amount of $1,500.00 payable to the Ohio EPA, Permit No. 3GQ00053 BG; Seconded by Trustee Laubacher.

 Consider Auctioning Dump Truck via GovDeals.com

 

Administrator Fetzer asked the Board to consider authorizing the placement of the 1988 Ford Dump Truck at a $6,000.00 reserve amount on GovDeals.com. 

 

Administrator Fetzer stated that GovDeals.com is an online auction solution often described as eBay-like and built exclusively for government surplus.  The site only sells surplus and confiscated items for government entities such as townships, cities, counties, states, school boards, public utilities, law enforcement, etc.  The general public is welcome to bid on items, however not authorized to sell items. 

 

Trustee Laubacher made a motion that the Board authorize the placement of the 1988 Ford Dump Truck at a $6,000.00 reserve amount on GovDeals.com; Seconded by Trustee Chessler.

Consider Purchase of Monitor Brackets

 

Fire Chief Martin stated that the Fire Department is requesting the Board of Trustees to authorize the purchase of five (5) ECK monitor brackets from National Creative Enterprise for installation in each medical unit, price not to exceed $2,500.00.

 

Chief Martin stated that the monitor brackets secure the monitor so that the monitor is not a loose item in the patient care compartment.  Three (3) quotes were obtained, the lowest of these being from National Creative Enterprise.  The Fire Department recommends National Creative Enterprise since it is the low quote.

 

Trustee Chessler made a motion that the Board authorize the purchase of monitor brackets from National Creative Enterprise, based on the quotes received, in an amount not to exceed $2,500.00; Seconded by Trustee Laubacher.

Consider Purchase of EMS Safety Jackets

 

Fire Chief Martin stated that the Fire Department is requesting the Board of Trustees to authorize the purchase of High-Visibility, ANSI Plus 2 rated EMS Jackets from Fire Force, Inc. for a total purchase not to exceed $7,625.00.

 

Chief Martin stated that the Manual of Uniform Traffic Control Devices, published by the U.S. Department of Transportation Federal Highway Administration, requires that emergency responders wear high-visibility apparel whenever they are exposed to moving traffic. 

 

Chief Martin indicated that to comply with this law, the fire department needs to purchase Class 2 or 3 high-visibility EMS Safety jackets of all part time personnel.  Full time personnel must purchase safety apparel from their uniform allowance.  Part time personnel do not receive a uniform allowance.

 

Trustee Laubacher made a motion that the Board of Trustees authorize the Fire Chief to purchase the High-Visibility, ANSI Plus 2 rated EMS Jackets from Fire Force, Inc. at a total purchase not to exceed $7,625.00; seconded by Trustee Chessler.

Consider Resignation of Chip Vincent

 

Fire Chief Martin stated that the Fire Department is requesting the Board of Trustees to accept the resignation of Chip Vincent, effective Tuesday, December 3, 2013.

 

Chief Martin gave a brief description of Chip Vincent’s employment history with the Perry Township Fire Department and his current employment status.  Chief Martin also stated that Chip has always been an outstanding firefighter and would be welcomed back on the department if his current work schedule changes. 

 

Trustee Chessler made a motion that the Board accept the letter of resignation of Chip Vincent, effective Tuesday, December 3, 2013; Seconded by Trustee Haines.

Consider Purchase of Road Deicing Salt for 2013/2014 Season

 

Road Superintendent Masalko is requesting the Board to authorize the purchase of road deicing salt for the 2013-2014 snow season at any given time.  The road deicing salt will be delivered at the Road Department salt dome.  Road Superintendent Masalko also requests permission to use the services of DRS Services, Inc. for the salt elevation for a total combination not to exceed $243,960.00.

 

Trustee Haines stated that in reference to the controversy that had been noted in the newspaper between the county and state regarding the pricing of deicing salt, he asked if the Township could plan to get the lesser price percentage for next year.  Mr. Masalko stated that yes, they would try and bid with ODOT for next year since their percentage prices dropped in price last year and this year.  The price quotes were not known before a service commitment was already made.

 

Law Director Hall indicated that one of the considerations, both from ODOT’s perspective and the county’s perspective, is in order to get part of the current year pricing on deicing salt, there has to be a  commitment of a minimum of tons.  The price cannot be determined until it is known how many tons will need to be purchased.

 

Trustee Haines made a motion for the Board to give the Road Superintendent permission to purchase road deicing salt for the 2013-2014 snow season and in addition, authorize the services of DRS Services, Inc. for the salt elevation, for a total combination not to exceed $243,960.00; Seconded by Trustee Chessler.

Road Superintendent Masalko is requesting the Board of Trustees to accept the resignation of Michael H. Dotson, effective November 27, 2013.

 

Trustee Haines made a motion that the Board accept the letter of resignation of Michael H. Dotson as a Perry Township seasonal road department employee, effective November 27, 2013; Seconded by Trustee Chessler.

Public Speaks-Open Forum:  

 

Tim Blythe, 2956 Bridgeton St. NW, Massillon, OH  44646 – Mr. Blythe inquired in reference to the road deicing salt, if there was an advantage to buying the road salt off-season.  For example, if buying the salt in April, May or June would be less expensive.  Road Superintendent Masalko stated no, the price of the salt stays the same until the re-bid of the next year.

 

Don Fick, 129 Saratoga Ave. NW, Canton, 44709 – Mr. Fick stated that he sees no patrol in the Yukon and Saratoga areas.  Mr. Fick stated that today around 5:15, he was over at his son’s house on Yukon and saw a driver barreling down the street and a second driver speeding so he yelled at him. 

 

Trustee Haines inquired of Mr. Fick whether he knew if the majority of the drivers that speed are neighbors or drivers who are using those streets as a shortcut through to Rt. 172.  Mr. Fick stated that he didn’t know that.  Trustee Haines inquired if Mr. Fick saw any improvements in relation to speeding in the morning hours.  Mr. Fick stated that for now, it has calmed down.  In the evening, he sees people driving straight through the stop signs.  More discussion continued.  Chief Pomesky stated that he has had extra patrol in these areas and no significant violations were reported, if any.  Chief Pomesky stated that he would continue to have patrol in these areas. 

 

Mr. Fick stated that Trustee Haines needed to sit in his front yard to see these violations occur.  Trustee Haines stated that he would agree to that and stated that they would continue to work on this matter.
