The Perry Township Board of Trustees meets in Regular Meeting format on the first and third Tuesday of every month at 7:00 PM.   

The meetings are held at the Township Hall located at

3111 Hilton Street NW

in Massillon. Regular Meetings include reports by Department Heads, the Law Director, and the Township Administrator.  The public is welcome to offer comments during the Public Speaks portion of the agenda on township related matters.

Recognition of Central Catholic Boys 2014 ~ State Champion Golf Team

 

Trustee Laubacher stated that we have some guests with us here this evening that we would like to recognize – Central Catholic Boys Golf Team Coach Dave Oates and the Central Catholic Boys 2014 State Champion Golf Team.  Trustee Laubacher asked if Coach Oates would step forward with the members of his golf team so the Board could recognize each of them with a Certificate of Achievement.

 

Trustee Laubacher stated that the Board is pleased to recognize these young men who have brought such positive recognition to Perry Township.  On behalf of the Board of Trustees, Trustee Laubacher congratulated each of these young men on their extremely outstanding achievement~2014 Ohio High School Division II State Golf Team Champions:   Evan Jenkins, Ryan Mallette, Drew Savage, Mark Mokros, and Jarrod Kasunick. 

 

Coach Dave Oates stated that he and the Golf Team were honored to be here this evening and thanked the Board for having them here as well.

 

Coach Oates also referred to the other Central Catholic students who were in attendance at this evening’s meeting and explained that they were students from the Central Catholic Government classes.  Coach Oates explained that were attending tonight’s meeting as a requirement of the Government class wherein each student must attend two (2) public meetings each quarter.

Police Levy Question and Answers Session

 

Trustee Laubacher stated that at this time, they would take questions from the residents concerning the upcoming Police Levy.

 

Richard Moore, 1732 Bramblebush St. NW, Massillon – Mr. Moore stated that he believes that this year we have had three (3) police levies, is that correct.  Trustee Haines stated that this would be the second one, the last one being in August 2014.  Mr. Moore asked how much the special election August levy cost.  Fiscal Officer Schlegel stated that he did not know that number yet as we have not been billed for this levy, but gave an estimate of $15,000-$18,000.  Mr. Moore stated that it is his understanding that we need an additional 3.49 which will, if passed, knock two (2) other existing levies off of there, correct.  Trustee Haines stated that was correct.  Mr. Moore stated that when those levies were due to expire in 2017, will those levy amounts be added back on or in other words, are we going to reduce things down to 1.74—are we going to add those two (2) levies back into it and bring it back up to 3.49.  T

 

Trustee Haines stated that at this time we have a 1.25 and .05 and we are asking for 1.74, the new levy amount, so the previous 1.25 and .05 will be part of that 3.49 and therefore, the 1.25 and .05 will be gone.  Mr. Moore inquired if they would then be wiped off the slate.  Trustee Haines stated that was correct. 

 

Fiscal Officer Schlegel stated that the levy amount is 3.49 and as soon as that levy is passed, the Board will do away with the 1.25 and .05 immediately and that would bring the new millage to 1.74. 

 

Mr. Moore stated that according to the Repository, the Trustees have promised to eliminate two (2) existing Police levies, 1.25 and .05.  Mr. Moore also read from the article he was referring to in the Repository: “election of the new money totaling about $840,000 at 1.74 mils would begin in January.  If the additional measure is approved Schlegel said, new cost to the owner of a $100,000 home would be $69.05.”  Mr. Moore stated that it appears to him that it won’t be 3.49, it would be reduced by the amount of the other two (2) levies that will be taken off the slate, if passed.

 

Trustee Haines stated that he could understand the way Mr. Moore would think that in the way the Repository article was written but further explained that the 1.25 and .05 will be taken off the books but they will be included in the 3.49 that will be in existence for five (5) years. 

 

Fiscal Officer Schlegel explained that it is actually a net of the 1.74 but you subtract it.

 

Mr. Moore inquired what does the Perry Police cost the citizens of the Township.  Mr. Moore referred to another article wherein “Jackson Township costs its residents about $225.00 per resident.”  Mr. Moore asked what does Perry cost.  Mr. Schlegel stated that he did not know what that amount would be per resident, but added that he could give Mr. Moore the amount that the budget is. 

 

Trustee Haines inquired what the total amount would be for a $100,000 home.  Mr. Schlegel stated that the 3.49 levy would be $122.15 per $100,000 home, and inquired if that was what Mr. Moore was inquiring about.  Mr. Moore stated no, that Michael Hank who writes for the Repository is quoting the City of Green which is protected by the Summit County Sheriff’s Department: “with 26,000 residents, it costs about $74.00 a year per resident to have the Sheriff’s Department”.  Mr. Moore added that Plain Township with 35,000 residents costs about $46.00 per year with the Sheriff’s Department protection.  Mr. Moore stated that it doesn’t quote Perry Township and added that he had not received an answer back from him.  Mr. Schlegel stated that a Township is done by the price of the house.  Mr. Moore stated that Jackson Township was quoted and reiterated his question: what it would cost a Perry Township resident per person.

 

Mr. Schlegel stated that would make it $2,752,129.22 to what the appropriations would be for this year, and you would take this and divide it by the amount of residents we have, approximately 28,000.  Trustee Haines stated that this would be $97.00 per resident.  Mr. Moore stated his thanks.

 

Tim Blythe, 2956 Bridgeton St. NW, Massillon – Mr. Blythe stated that a couple of questions he had at a previous meeting got muddied up a little bit and further stated that the big question that he has is again: what services, if this levy passes, would be added, and if the levy fails, what services would be eliminated.  Mr. Blythe stated that he knows that there is some talk about some things that the Township and the Police Department wants to do, but if you back up to May, when we ran the Road Levy, it was very clear, if this levy passes, we will eliminate a specific type of paving that we do that will provide asphalt paving.  Mr. Blythe stated that with this levy, “I still say there is not a very clear answer of what this money is going to pay for”.  Mr. Blythe further added that if the levy would fail, one of the remarks that Mr. Haines made was that we didn’t want to scare our employees and Mr. Blythe added that he gets that but however, do we not want to scare them or do we want to surprise them with a notice that they are going to be laid off.  Mr. Blythe asked what type of services were going to be eliminated and how deep those cuts would be.  Mr. Blythe further stated that he thought that this was a valid question and added that we need to know that it’s possible that we are going to have only one person on the road instead of two or two instead of four or whatever that may be.  Mr. Blythe stated that he thought that this was a legitimate question and added that he thought it should be answered.

 

Trustee Haines stated to Mr. Blythe that in answer to his question at the last meeting, he indicated that we are going to have a budget deficit this year.  Trustee Haines further added that as we discussed at the last meeting, when you pass a levy, you pass it for the next five (5) years because that is how long that levy is.  So you have a rollover for the first couple of years and then you break even.  Trustee Haines stated that for Mr. Blythe to ask what we are going to add to the police department, the flyer that went out to all the residents stated those needs and the possibilities we would like to add to the Police Department.  Trustee Haines further added that on the same token, if the levy does not pass, there are cuts that will have to take place.  Trustee Haines stated that those cuts are not spelled out yet but added that in the paper after the last meeting, some speculations were made and those were not discussed at the meeting. 

 

Mr. Blythe stated that for example when the Chief comes to the Board and states that he needs more money to run his department, he added that he cannot believe that there is not some type of plan that says this is why I need the money and this is how the plan works out and this is what the plan costs.  Mr. Blythe stated that he cannot believe that the questions were not asked by the Trustees as to what if the levy does not pass, where will those cuts have to be made.  Mr. Blythe stated that we are two (2) weeks away from either passing or failing this levy and we do not have a plan.  Either way, we don’t know what we are going to do if it passes and we do not know what we are going to do if it fails.  We just need money.  That doesn’t make any sense. 

 

Trustee Haines stated that there has been discussion.  Mr. Blythe asked “what is it”. 

 

Fiscal Officer Schlegel stated that if the levy fails, he stated this at the last meeting, there will be lay offs. 

 

Police Chief Pomesky stated that at the last meeting, he acknowledged that he would explore staffing enhancements to the Township to provide direct services to the residents.  Chief Pomesky added that he had also mentioned that vacant K-9 position that has been vacant for some time that we are unable to fund.  Chief Pomesky stated that there are several patrol officer positions that cannot be filled but those services that we would like to bring back are going to directly be made for the benefit of the residents.

 

Mr. Blythe stated that he was sure that Chief Pomesky knew how much a K-9 unit cost a year, you know how much it would cost to have a full time person opposed to a part time person.  Mr. Blythe stated that at the same time, he believes Chief Pomesky knows how much money, if this levy passes, you are going to need to replenish the deficit that we have and you know how much money is going to be left, those are spelled out.  Chief Pomesky stated that it will be an on-going process to be able to get these things back and this levy is the first step in doing that.

 

Mr. Blythe briefly described a past fire levy that passed to make his point that it was spelled out exactly what services would be implemented.  Mr. Blythe stated that he was not trying to argue but stated that his issue was that he comes to every single meeting and even he cannot understand all of this.  Mr. Blythe added that he doesn’t know how a person is going to go vote yes or no on a levy when they cannot understand what they are voting for.

 

Mr. Blythe referred to the comments made earlier by Mr. Moore regarding the levy and pointed out that he was under the impression that we had two (2) or three (3) levies in the last year.  Mr. Blythe stated that he felt that we have done a poor job in getting the message across of what services we are going to provide if the levy passes and what services we are going to eliminate if the levy fails.  Mr. Blythe stated that by not doing that, he feels that this is going to cost us.

 

Chief Pomesky stated that if the levy should fail, it would potentially eliminate four (4) to six (6) positions within the Department anywhere from road patrol positions to our school officers, potentially dispatchers; it could be a blend of those individuals.  The cuts would be devastating and compromise the safety to our community.  Chief Pomesky stated that he has been up front with Mr. Blythe at the last meeting and is being up front again that the failure of this levy will have a drastic affect in our Township. 

 

Chief Pomesky stated that with the passage of the levy, and being in tune with the community through door-to-door and speaking to many community groups, the residents want to see not only our continued services, but are interested in the direct services to the Township.  Chief Pomesky stated that one of the things that the Police Department provides that is unique to our community is our school safety initiative where we are bringing in over a 150 radios from our school administrators in our dispatch center.  We want to keep those programs alive.  It does cost money and it does cost money to build those programs to make our community safe.  Chief added that our officers not only do the basic road patrol functions, but, as an example, a few years back, there was a break in at the B & K Restaurant.  The officers were able to collect the rock at the scene that left the DNA of the person who threw it and we solved the crime.  So when you look at staffing in a Police Department, you can’t put all of your budget in one basket, you have to build a system where they have the evidence, the forensics and the correct technologies.  Those are the things that we are bringing to the table, the total package.  

 

Mr. Blythe stated that he understands that but his issue is that if this levy is not going to add one body, what it is going to be used for.

 

Chief Pomesky stated that it will be used for not only the day-to-day activities but it is going to carry us into the future and we will focus on bringing back staffing positions that we have not been able to put on the table with the reduction in the current budget.  Chief Pomesky stated that he would like to hire in the vicinity of three to six officers but added that we have to have the money to come in, get the levy passed for those goals to hire those individuals.

 

Mr. Blythe inquired that after we take care of all of our deficits that we know we have, how much additional money do we have left. 

 

Fiscal Officer Schlegel stated that for the first year, roughly $500,000.  Mr. Blythe stated that $500,000 will not pay for six officers if they have to be laid off.

 

Trustee Haines stated that this was an estimate of the number of officers that would have to be laid off and added that is why when Chief Pomesky puts his budget together, he would look at that.

 

Trustee Laubacher asked if anyone else had a question in regard to the upcoming police levy.

 

Dave Kerestes, 3500 Lincolnway East – Mr. Kerestes stated that he had multiple reports with him.  “All these fires and incidents at my house”.  Mr. Kerestes read the following from one of the police reports he had with him: “contact will conduct further investigation tomorrow” and stated that he has been waiting four (4) years in regard to his truck fire and has been waiting three (3) years in regard to his house fire.  Mr. Kerestes inquired if there would be officers to conduct proper investigations because they haven’t been doing that for years.

 

Chief Pomesky stated that we have officers on staff right how and they do a thorough job with their investigations.  Mr. Kerestes stated that this is a matter of opinion.

 

Trustee Laubacher thanked everyone for their questions and to Chief Pomesky for his comments.  Trustee Laubacher stated that he would also like to add that Chief Pomesky has been very cautious about buying new cruisers and knows that there are quite a few miles on the current cruisers.  It is hopeful that instituting some new cruisers will be something we can look forward to with the passage of the levy.

 

Richard Moore – Mr. Moore inquired what the cost would be of a four wheel drive Ford Explorer as opposed to a conventional cruiser equipped and ready to go down the road.  Chief Pomesky said that actually and surprisingly it’s been far better than a patrol car.  Chief Pomesky explained that the Crown Vics run with a V-8 and the Ford Explorers run with a V-6.  Chief Pomesky stated that an estimate of the cost would be about $35,000 for the Ford Explorer.  Chief Pomesky gave a brief detail of the department officers using the Crown Vics versus the Ford Explorer vehicles.

 

Dave Kerestes – Mr. Kerestes made a comparison reference to a past personal police matter incident(s) of his in relation to a police incident the Chief just spoke about.  Trustee Laubacher asked Mr. Kerestes if he would please wait until the Public Speaks portion at the end of the meeting if this was not something specifically in relation to the police levy topic.

 

Communications: 

 

Letter Received from John Strazisar Requesting Four Way Stop Signs

 

Trustee Laubacher stated that the Board is in receipt of a letter from John Strazisar requesting a four way stop sign at 7th Street and Ambrose NW and 7th Street and Manor NW.  Trustee Laubacher referred to a speed zone trailer placed near these locations by the Police Department.  Trustee Laubacher also stated that the Board would like to confer with the Law Director and Road Superintendent on this matter and will get back to Mr. Strazisar.  Mr. Strazisar gave a brief explanation of the dangers of drivers in his neighborhood area and explained that he would be willing to distribute a petition for this four way stop request(s).

 

Trustee Haines explained to Mr. Strazisar that a traffic study must be implemented through the Stark County Engineer’s Office to address this request .  Mr. Strazisar thanked the Board for their time and Trustee Haines thanked Mr. Strazisar for his concern.

 

Letter from Leonard Patton ~ Drainage Concern Ashton and Chippendale

 

Trustee Laubacher stated that he had been out to Mr. Patton’s house to evaluate the drainage concern along with Road Superintendent Masalko and wanted to relay that he would be forwarding a letter to the Board to explain this issue within the next two (2) weeks.

 

Invitation from Officer Bardnell ~ SOLACE Town Hall Meeting

 

Trustee Laubacher stated that the Board had received a notice for the SOLACE Town Hall Meeting at Exploration Gateway held on Monday, October 20, 2014.

 

Letter from Kirk Norris: Stark County Health Department ~ Ebola Update

 

Trustee Laubacher stated that Stark County Health Commissioner, Kirk Norris had sent a letter to all City, Village and Township Administrators in regard to the Ebola situation and communicated that they would continue any updates when necessary.

Trustee Laubacher made a motion to approve bills in the amount of $33,986.70 for the week ending October 14, 2014 and bills and payroll in the amount of $140,914.80 for the week ending October 21, 2014 for a combined total of $174,901.50; Seconded by Trustee Chessler.

Consider Total Tax Rate for Tax Year 2014 ~ 13.15 mills equals $5,699,872.00

 

Fiscal Officer Schlegel stated that he is requesting the Board’s approval for the passage of the 2014 Tax Rates being 13.15 mills that equals $5,699,872.00.

 

  • General Fund  –  .10 mills ~ $48,301.00
  • Loan Bridge Fund – 1.50 ~ $721,110.00
  • Fire Levy – 2.9 mills ~ $1,398,454.00
  • Police Levy – 1.25 mills ~ $599,945.00

Trustee Chessler made a motion that the Board approve the tax rate for the tax year 2014 of $13.15 mills which equals and yields $5,699,872.00; Seconded by Trustee Haines.

Administration: 

 

Consider Accepting OTARMA Grant in the amount of $500.00

 

Administrator Fetzer stated that she is asking for the Board’s consideration to accept the OTARMA MORE Grant in the amount of $500.00.  The MORE acronym stands for Managing Ohio Risks Exposures.  For the second consecutive year the Board of Directors has awarded the Grant in the amount of $500.00, available to every OTARMA member.  Consideration of the grant is given upon submission and completion of the application.  Administrator Fetzer briefly explained that the grant can be utilized for safety equipment, risk management safety training workshop, etc.

 

Administrator Fetzer stated that last year, Perry Township utilized the MORE Grant for $500.00 toward safety equipment in the way of vests, safety goggles, gloves and safety hats for the Park and Road Departments.  This year the $500.00 grant money was utilized for mulch placement in all the Perry Parks. 

 

Trustee Haines made a motion that the Board accept the OTARMA Grant in the amount of $500.00 for the calendar year 2014; Seconded by Trustee Chessler.

Consider Editing Community Event Policy

 

Administrator Fetzer stated that in 2013 the Board of Trustees adopted a well written Community Events Policy.  Since that time, the Department Heads have implemented the policy on several occasions such as:

 

  • The Canton Hall of Fame Marathon
  • The Funny Bunny Run
  • The Matt McCleese Community Run
  • The Bicentennial HEROES 5K Run/Walk
  • The Bicentennial Parade
  • The upcoming 18th ~ Perry Rotary Bicentennial Turkey Trot

 

 

 

Administrator Fetzer stated that during the implementation process, the Department Heads have discovered that edits d, e, and f on page 2 of 8 would assist in better communicating to the event applicants what additional information is required in order to better communicate to all parties involved.  Residents, volunteers, etc.

 

Administrator Fetzer is requesting the Board to consider accepting the proposed edits d, e and f on page 2 of 8 according to the Perry Township Community Events Policy.

 

Trustee Chessler made a motion that the Board adopt an addition amending our current Community Events Policy to add those items currently on page 2 listed in the subscripts of paragraph 7 of d, e and f; Seconded by Trustee Haines.

Consider Frank Gates Group Retrospective Rating Program

 

Administrator Fetzer stated that last year Assistant Vice President Frank Gates came and gave a presentation to the Board.  Administrator Fetzer also stated that at that time, Mr. Gates recommended that the Board adopt the Group Retrospective Rating Program for the calendar year 2014.  A traditional group rating is determined each year by claims brought to the table and we are ineligible this year for the traditional group so they are recommending that for 2015 we also contract the new rating           retrospective.  Perry Township is currently participating in all of the current possible BWC programs which provide Township to Township and maximum savings and will allow us to continue to receive rebates such as the Stark County Safety Council, Maps Free and Go Green.  Group Retro has estimated a refund of $47,932. 

 

Administrator Fetzer is requesting the Board to consider all of the aforementioned benefits and is requesting the participation of the 2015 Group Rating for Retrospective Rating Program administered by Frank Gates in the amount of $6,901.00.

 

Trustee Chessler made a motion that the Board of Trustees continue to participate in Group Retrospective Rating Program for the year 2015 for the service fee of $6,901.00; Seconded by Trustee Laubacher.

Consider Renewal of Mandated MS4 Administration Permit $200

 

Administrator Fetzer stated that this permit is separate from the permit the Board is required to pay in December in the amount of $1,500.00.  Administrator Fetzer stated that this is the Administration portion of that.

 

Administrator Fetzer stated that the Ohio EPA mandates that MS4 Facility Permit holders complete the Notice of Intent (NOI) form and renew the permit in the amount of $200.00 every five (5) years.

 

This fee is to cover all Administrative functions of the Ohio EPA.  The permit renewal is applicable to Perry Township and all government entities concerning general permit coverage. 

 

Administrator Fetzer stated that she is requesting the Board to consider making a motion to authorize payment to the Ohio EPA in the amount of $200.00 for the renewal of the MS4 permit.

 

Trustee Laubacher inquired if the $1,500.00 fee was part of the Administration portion.  Administrator Fetzer stated that the $1,500.00 portion, due in December, is the total MS4 permit, the stand alone permit by itself and this $200.00 is the Administrative portion.

 

Trustee Chessler stated, with regret, makes a motion that the Board authorize the payment to the Ohio EPA for the permit fee of $200.00; Seconded by Trustee Haines.

 

Trustee Laubacher inquired if this fee would come out of the Road Department.  Administrator Fetzer stated that this would come out of the same fund that would be for the regular MS4 permit.  Fiscal Officer Schlegel stated that this would then come out of the Road or General Fund.

Consider Step 2 Grievance of Officer, Joshua Luke

 

 Police Chief Pomesky stated that he was made aware on Monday that the Board had received a Step 2 Grievance for discipline that Officer Luke had received previously.  Chief Pomesky stated that he had responded to Officer Luke’s grievance in Step 1 and added that this grievance was not filed timely and is outside of Article 17; Section 17.3.  Chief Pomesky stated that his recommendation for the Board is to deny the Step 2 hearing and send the correspondence back indicating the same.

 

Trustee Laubacher inquired of Chief Pomesky how many days Officer Luke had to respond to his answer.  Law Director Hall responded that under the new contract language, it is five (5) calendar days and that was a change requested by the union.  Trustee Chessler stated for the record, if the day the grievance was acted upon by the Chief could be stated to indicate that it was five (5) days after that. 

 

Chief Pomesky stated that Officer Luke’s grievance was filed with him on the 16th of October 2014 and the date of Chief’s response was October 17, 2014. 

 

Trustee Haines inquired what the time frame was on this.  Chief Pomesky stated that the time frame was from the time he was served with a notice of discipline on October 9th.  Trustee Chessler stated that was what he was asking, the date of the event.  Chief stated that the discipline date was on October 9, 2014 and Officer Luke filed a grievance on October 16, 2014 that should have been filed on October 14, 2014.

 

Trustee Haines stated that based upon the recommendation of the Chief of Police and Law Director, makes a motion, pursuant to Article 17; Section 17.3 of the Collective Bargaining Agreement, that October 17, 2014 Step 2 Grievance as submitted by Perry Township Police Officer Josh Luke is not timely filed and the grievance shall be denied; Seconded by Trustee Chessler.

Road Department:

 

Consider Accepting Letter of Resignation from Part-Time Employee Roger Tournoux

 

Trustee Haines, standing in for Road Superintendent Masalko, stated that the Road Department is requesting that the Board accept the resignation of part-time employee Roger Tournoux, effective September 19, 2014, letter of resignation read by Trustee Haines, attached before the Board.

 

Trustee Haines made a motion that the Board accept the letter of resignation of part-time employee Roger Tournoux effective September 19, 2014; Seconded by Trustee Chessler.

Trustee Chessler stated that as the Board is aware, we have been looking at the problems existing in the Summerdale allotment for several years.  Trustee Chessler stated that the Board has even gone to the extent of making application in years prior to get funding to assist the Board in meeting the costs of this project.  Trustee Chessler stated that we have finally come to the point that we have refined our request, have received an engineer’s estimate in the amount of $1.1 billion dollars and now is the time that we need to solicit for bids.

 

Trustee Chessler made a motion that the Board authorize the solicitation of bids for the Summerdale Partridge Storm Sewer Project, those bids to be submitted to the Township Offices and to be received on or before November 18, 2014 at the Township Hall by 2:30 pm. and they will be opened and reviewed and considered further at our next regular meeting on November 25, 2014; Seconded by Trustee Haines.
